If your loved one has been Baker Acted, time is not on your side.
You have a very short window of opportunity to make it to the courthouse and prevent your loved one from becoming a ward of the state.
As soon as your loved one is Baker Acted, the clock may start ticking.
You’ve got less than 72 hours to protect their rights.
Your loved one can be legally held in a Baker Act facility for an initial 72-hour observation period. During that time the Baker Act facility WILL be looking for reasons to file a petition for involuntary placement and hold your loved one far beyond the observation period.
If they are successful, your loved one could be held against their will in a state mental health facility for up to 6 months. The best way to protect your loved one’s rights and freedom is to take action as quickly as possible.
Your first call should be to an attorney that’s well-versed on the Baker Act. Your attorney’s goal will be to get to the courthouse before the Baker Act facility does to petition the court for your loved one’s release.
If the Baker Act facility beats you to the courthouse and the judge rules in their favor, it may be too late. Your loved one will be forced to remain in a state facility for the duration of their court-mandated stay.
Don’t let your loved one become a ward of the state.
If someone you love has been Baker Acted, you must call immediately.
