In November of 2020, New Jerseyans were given the opportunity to voice their opinions on the legalization of the recreational use of marijuana. After a unanimous vote to legalize the drug recreationally, this past February the new law was put into affect. With the introduction of such a foreign concept, both employees and employers may be confused on what these laws mean to them in their professional setting. The law will protest cannabis users as employers will be prohibited from punishing an employee based off of marijuana use, as long as the use is done so out-of-office. With that being said, employers will be able to take action against employees for their marijuana use if it is apparent that an employee is using the drug at work, intoxicated on the job, or suffering from after work injuries as a result of ones marijuana use. However, as the recreational use of marijuana is still in its infancy there is not a way to accurately test someone on sight for intoxication for marijuana. The factor of inaccurate testing will in turn lead employees to be able to fight any consequences they may face for the use of marijuana at work in court, which may also deter employers from taking action against employees for use of the drug.
